These Terms of Service govern your use of Lovegotchi and the services provided by Qewiy Games. Last updated June 17, 2026.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Qewiy Games ("we," "us," or "our") governing your access to and use of the Lovegotchi mobile application, website, and related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your country or territory (typically 18), you may only use the Service with the verifiable consent of a parent or legal guardian, who accepts these Terms on your behalf.

By using the Service, you represent and warrant that:

• You are at least 13 years of age;
• You have the legal capacity to enter into these Terms;
• You are not prohibited from receiving the Service under applicable law; and
• You will comply with these Terms at all times.

We reserve the right to terminate accounts we reasonably believe belong to users under 13 without prior notice.

3. Accounts & Pairing

To access the full Service, you must create an account. You agree to provide accurate, current, and complete registration information and to keep it up to date.

Pairing. Lovegotchi is designed for use by two people ("a Pair"). You may share one Mochi companion with exactly one other user at a time. Attempting to pair with multiple users simultaneously or circumvent the pairing system is prohibited.

Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@lovegotchi.com if you suspect any unauthorised access to your account.

One account per person. You may not create multiple accounts for the same individual. Accounts are non-transferable.

4. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to:

• Download and install the Lovegotchi app on devices you own or control;
• Access and use the Service for your personal, non-commercial purposes.

This licence does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Service or any content therein. All rights not expressly granted are reserved by Qewiy Games.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to harass, abuse, stalk, threaten, defame, or harm any person;
• Upload or transmit any content that is unlawful, obscene, hateful, or infringes third-party rights;
• Attempt to gain unauthorised access to any part of the Service, its servers, or connected systems;
• Reverse-engineer, decompile, disassemble, or create derivative works of the Service or its components;
• Use automated means (bots, scrapers, crawlers) to access or interact with the Service;
• Interfere with or disrupt the integrity or performance of the Service;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Circumvent, disable, or otherwise tamper with security features of the Service;
• Use the Service for any commercial purpose without our prior written consent; or
• Violate any applicable local, national, or international law or regulation.

We reserve the right to investigate suspected violations and may cooperate with law enforcement authorities.

6. In-App Purchases & Billing

Lovegotchi is free to download and play. Certain cosmetic items and in-game Coin packs are available for purchase ("Paid Content"). Coins earned through normal gameplay are distinct from purchased Coins.

Payment processing. All purchases are processed by Google Play under its terms and payment policies. We do not directly handle payment card information.

Pricing. All prices are displayed in your local currency where supported. Prices are inclusive of applicable taxes unless otherwise stated. We reserve the right to change prices at any time with reasonable notice.

Refunds. Refund eligibility is determined by Google Play's refund policies. We are unable to process refunds directly.

No resale. In-app Coins and Paid Content are non-transferable, have no cash value, and may not be sold, traded, or transferred to any other user or account.

7. Subscriptions

If we offer subscription-based features ("Subscription"), the following additional terms apply:

• Billing cycle. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• Cancellation. You may cancel your Subscription at any time through your app store account settings. Cancellation takes effect at the end of the current paid period; you will not receive a refund for any unused portion.
• Free trials. If a free trial is offered, it will convert to a paid Subscription at the end of the trial period unless you cancel beforehand.
• Price changes. We will provide reasonable advance notice of price changes. Continued use of a Subscription after a price change constitutes acceptance of the new price.

8. User Content

Ownership. You retain all ownership rights in photos, messages, notes, and other content you submit to the Service ("User Content"). We do not claim ownership of your User Content.

Licence grant. By submitting User Content, you grant Qewiy Games a limited, worldwide, royalty-free, non-exclusive licence to host, store, reproduce, and display your User Content solely as necessary to provide and improve the Service for you and your paired partner. This licence terminates when you delete the content or close your account, subject to reasonable backup and caching periods.

Your responsibility. You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to the User Content you submit, and that it does not violate any third-party rights or applicable law.

Monitoring. We do not routinely monitor User Content, but we reserve the right to remove content that violates these Terms or applicable law without prior notice.

9. Intellectual Property

The Service and all content, features, and functionality — including but not limited to the Mochi character, artwork, animations, software, text, graphics, logos, and design — are owned by Qewiy Games and are protected by copyright, trademark, and other intellectual property laws.

"Lovegotchi," "Mochi," "Qewiy Games," and associated logos are trademarks of Qewiy Games. You may not use these marks without our prior written consent.

Feedback or suggestions you voluntarily provide to us may be used by us without any obligation to you.

10. Privacy

Your privacy matters deeply to us. Our Privacy Policy describes how we collect, use, store, and share information about you when you use the Service. By using the Service, you agree to our data practices as described in the Privacy Policy.

Key points:

• We collect only the data necessary to provide the Service.
• Chats between you and your partner are end-to-end encrypted; we cannot read them.
• We do not sell your personal data to third parties.
• You may request deletion of your data at any time from Settings or by emailing us.

11. Third-Party Services

The Service may integrate with or link to third-party services and platforms, including Google Play, Firebase, and others. These third-party services are governed by their own terms and privacy policies, and we are not responsible for their content, practices, or availability.

Your use of any third-party service is at your own risk. We encourage you to review the terms and privacy policies of any third-party services you interact with through the Service.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free;
• Any errors or defects will be corrected;
• The Service or servers are free of viruses or other harmful components; or
• The results obtained from using the Service will be accurate or reliable.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QEWIY GAMES, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; or
• Unauthorised access, use, or alteration of your transmissions or content.

In any case, our total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50.

14. Indemnification

You agree to indemnify, defend, and hold harmless Qewiy Games and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with:

• Your access to or use of the Service;
• Your User Content;
• Your violation of these Terms; or
• Your violation of any rights of another person or entity.

15. Termination

By you. You may stop using the Service and delete your account at any time from the Settings screen within the app. Deleting your account permanently removes your data subject to our Privacy Policy.

By us. We may suspend or permanently terminate your access to the Service at our sole discretion, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or your continued use poses a risk to other users or the Service.

Effect of termination. Upon termination, your licence to use the Service ends immediately. Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — shall survive.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Qewiy Games is registered, without regard to its conflict of law principles.

If you are a consumer resident in a jurisdiction that grants mandatory consumer protections, nothing in these Terms affects your statutory rights under those protections.

17. Dispute Resolution

We want to resolve any concerns you have quickly and informally. Before filing a formal legal claim, you agree to first contact us at support@lovegotchi.com and attempt to resolve the dispute in good faith. We will try to respond within 30 days.

If informal resolution fails, disputes shall be resolved through binding arbitration or in the courts of the governing jurisdiction, as applicable under local law. You waive any right to participate in a class-action lawsuit or class-wide arbitration to the extent permitted by law.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights.

18. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending an in-app notification or email.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
